Amendment to PB 25-05 & Dual Compensation Waivers for Law Enforcement Positions

This Department of Interior (DOI) memorandum amended a previous policy (PB 25-05) extending dual-compensation waivers for reemployed annuitants in law enforcement positions with a mandatory retirement age. Dual-compensation waivers allow retired employees already earning a full pension to also earn full salaries when reemployed (rather than reduce their new salary by the amount of that pension). This amendment makes it easier for DOI to rehire retired federal law enforcement officers and keep them on the payroll for longer. The reasons for this are twofold. First, where an officer's mandatory retirement age has already been extended to age 60, the department may now keep the dual-compensation waiver in place up to age 60. Second, this memorandum removes an earlier rule that had blocked giving the pay waiver to officers in these positions. The waiver authority runs through December 31, 2028; the department's Chief Human Capital Officer or Deputy Assistant Secretary for Human Capital, Learning and Safety may grant it case by case, on time-limited appointments, when needed to quickly bring back retirees to help protect visitors, residents, and public lands.
