Designation of Temporary Immigration Judges

The Department of Justice's Executive Office for Immigration Review (EOIR) issued this final rule altering the requirements for candidates for Temporary Immigration Judges (TIJs). The final rule allows the Director of EOIR, with the approval of the Attorney General, to select TIJs who do not have prior experience in immigration law to oversee cases. Prior to this final rule, individuals eligible to be designated as TIJs were limited to former Immigration Judges (IJs), Appellate Immigration Judges, EOIR administrative law judges (“ALJs”), and Department attorneys with at least 10 years of immigration law experience.
