Notice of Change in Position: Administrative Law Judges
Agency Filing or Order | September 18, 2025
The Department of Justice (DOJ) notified a federal court in litigation that the Trump administration would no longer comply with 5 U.S.C. § 7521, which provides for-cause termination rights for Administrative Law Judges (ALJs) and procedures for their removal. Instead, DOJ indicated that the administration would terminate ALJs summarily, with or without cause, based only on Article II of the Constitution.
