Temporary Transition Schedule C & Schedule C Authorities & Noncareer Senior Executive Service Appointing Authorities

When a new presidential administration begins, the administration can generally appoint Temporary Transition Schedule C positions (known as TTCs) to help with the transition. These TTCs are political appointees who serve for a short period — up to 120 days, if the term is not extended — at the beginning of a new administration. Ordinarily, the number of TTCs is subject to a specific cap: either three individuals, or 50% of the total number of permanent Schedule C individuals — whichever is higher. By regulation, the Office of Personnel Management (OPM) may increase this cap "to meet a critical need or in unusual circumstances.” 5 C.F.R. 213.3302(b). This OPM memo authorizes all agencies to hire an unlimited number of TTCs, citing "the unusually expansive and transformative agenda the American people elected President Trump to accomplish" as its justification. It also authorized the temporary hiring of additional non-career Senior Executive Service (SES) employees at some agencies, of terms not to exceed 30 days. In so doing, it noted that individuals whom the president nominates to senior positions often occupy these temporary positions while awaiting confirmation.
