Guidance on Executive Order: Exclusions from Federal Labor-Management Programs

In this memorandum, the Office of Personnel Management (OPM) provided guidance on EO 14,251, which excluded entire agencies or agency components from collective bargaining and instructed agencies to cancel collective bargaining agreements (CBAs). OPM's memorandum directed agencies that, upon cancellation of CBAs, they should immediately implement new personnel policies of the administration that were previously considered inconsistent with existing CBAs. Among other things, OPM’s memo directed agencies to disregard CBA provisions addressing reductions in force, return to in-person work directives, and use of agency space or resources for union activities. The memorandum also directed affected agencies to cut off funds to unions by ceasing to process union dues withholdings from the pay of employees who previously elected to have their dues paid directly to their unions out of their pay.
